1. Agreement to Terms

By accessing and using LeadsList ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

LeadsList provides a platform connecting contractors and construction professionals ("Users") with verified construction project leads ("Leads"). Users can browse available Leads and purchase contact information for projects of interest.

The Service includes:

  • Access to browse available construction project leads
  • Secure payment processing for lead purchases
  • User account dashboard for managing purchased leads
  • Email notifications for purchases

3. Account Registration

To purchase leads, you may create an account or checkout as a guest. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

4. Lead Purchases

4.1 Payment Terms

All lead purchases are processed securely through Stripe. By purchasing a lead, you agree to pay the listed price. All sales are final.

4.2 Lead Quality

We make reasonable efforts to verify all leads before listing. However, we cannot guarantee that:

  • Project owners will respond to your contact
  • Projects will proceed as described
  • You will be awarded the contract
  • Budget estimates are accurate

4.3 No Refunds

All lead purchases are final. Once you have access to contact information, no refunds will be issued. This policy exists because the value (contact information) is delivered immediately and cannot be "returned."

4.4 Lead Exclusivity

Leads are NOT exclusive. Multiple contractors may purchase the same lead. The number of times a lead has been purchased may or may not be displayed.

5. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Share purchased lead information with third parties
  • Attempt to scrape, copy, or harvest data from the Service
  • Create multiple accounts to circumvent our systems
  • Harass or spam project owners
  • Misrepresent your qualifications or capabilities
  • Attempt to gain unauthorized access to the Service

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by LeadsList and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose only.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Accuracy, reliability, or completeness of leads
  • Uninterrupted or error-free operation
  • Results or outcomes from using purchased leads

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEADSLIST SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your use or inability to use the Service
  • Any damages exceeding the amount you paid for the specific lead in question

10. Indemnification

You agree to indemnify and hold harmless LeadsList from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your interactions with project owners

11. Account Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or suspicious activity
  • Abusive behavior toward project owners or our staff
  • Any other reason at our sole discretion

Upon termination, you will still have access to previously purchased leads but cannot make new purchases.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the State of Pennsylvania, United States, without regard to conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Severability
